NDRC: Measures For Energy Conservation Review Of Fixed Assets Investment Projects

   On April 6, the Energy Conservation Review Measures for Fixed Assets Investment Projects revised and issued by the National Development and Reform Commission was released to the public. The NDRC said that this is an important measure to improve the system of energy conservation and carbon reduction, improve the regulation of total energy consumption and intensity, and will provide an important institutional guarantee for promoting green, low-carbon and high-quality development.  
   Energy conservation review of fixed asset investment projects is an important system to improve energy utilization efficiency of new projects and reduce energy waste from the source. Energy conservation review opinions are an important basis for project construction, completion acceptance and operation management. The Energy Conservation Law stipulates that the State implements the energy conservation assessment and review system for fixed asset investment projects. In November 2016, the National Development and Reform Commission issued the Measures for Energy Efficiency Review of Fixed Asset Investment Projects (Order No. 44 of the National Development and Reform Commission in 2016), which further streamlined the scope of the review, refined the requirements for the review, and improved the effectiveness of the review. Since the implementation of the energy-saving review system, it has played an important role in improving the energy efficiency of new projects, curbing the blind development of projects with high energy consumption, high emissions and low levels, and promoting the transformation and upgrading of the industrial structure, effectively promoting high-quality economic and social development. According to recent data estimates, the country can save more than 7 million tons of standard coal every year through energy conservation review.
   The newly revised Measures strengthen the effective connection with the total energy consumption and intensity control policies, and scientifically assess the energy consumption, energy structure, energy efficiency level, energy intensity, etc. of projects in the energy conservation review work, which can effectively play the role of energy efficiency control and ensure the high-quality development of energy demand; At the same time, guide projects to adopt more renewable energy, industrial waste heat, etc. according to local conditions, which is conducive to controlling fossil energy consumption and reducing carbon dioxide emissions.
   The relevant person in charge of the National Development and Reform Commission explained that the revision of the Measures further strengthened the supporting role of energy conservation review in improving the regulation of total energy consumption and intensity. The Measures clearly stated that the local departments in charge of energy conservation should strengthen overall guidance and coordination on energy conservation review, implement the regulation of total energy consumption and intensity, strengthen the management of binding indicators for reducing energy intensity, effectively enhance the flexibility of total energy consumption management, control the consumption of fossil fuels, and resolutely curb the blind development of projects with high energy consumption and high emissions; Add the accounting requirements for renewable energy consumption and raw material energy consumption in the energy conservation report, analyze the fossil energy consumption per unit product, fossil energy consumption per unit added value (output value), fossil energy consumption, renewable energy consumption and supply guarantee, raw material energy consumption, etc., and guide the increase of renewable energy consumption; For projects with carbon emission statistics and accounting conditions, carbon emission data should be accounted in the energy conservation report, carbon reduction measures should be proposed, and the impact of carbon emissions of the project on local carbon reduction goals should be analyzed. This further strengthens the synergistic role of energy conservation review in improving energy efficiency and reducing carbon emissions, and will provide strong support for the gradual shift to "dual control" of total carbon emissions and intensity.
   The Measures further improved the efficiency of examination and approval, and increased the administrative authority of provincial energy conservation review authorities from 5000 tons of standard coal to 10000 tons of standard coal in terms of annual comprehensive energy consumption; Support local governments to carry out regional energy conservation review in development zones, new areas and other areas where conditions permit, implement the notification and commitment system, and further optimize the approval process.
   The Measures optimized and improved the requirements for energy conservation review changes, reconstruction project boundaries, and overdue energy conservation review comments, providing guidance for relevant work. For example, when calculating the comprehensive energy consumption increment of the project, the original expression of "reconstruction and expansion project" is clearly defined as "reconstruction project with unchanged construction site, main production process and equipment", which clarifies the energy consumption accounting boundary of the project; For projects requiring significant changes in the construction site, construction content, construction scale, energy efficiency level, etc., or the actual annual comprehensive energy consumption exceeds 10% or more of the energy-saving review and approval level, the construction unit shall submit a change application; It is specified that if a single project involves two or more provincial regions, the energy conservation review shall be carried out after the provincial (district, city) energy conservation review authority of the province (district, city) where the main project (or control project) is located takes the lead and the provincial energy conservation review authority of other regions studies and determines. In addition, the Measures also require local governments to formulate specific implementation measures for energy conservation review in their own regions in combination with local conditions, so as to provide more precise guidance for system implementation.
   The Measures emphasize that the construction unit shall not start the construction of projects that have not been reviewed for energy conservation according to the provisions or have not passed the review for energy conservation, and those that have been completed shall not be put into production or use. The NDRC implements the dynamic supervision of the national energy conservation review, supervises and inspects the implementation of energy conservation review in various regions, and conducts irregular spot checks on the implementation of energy conservation review opinions of major projects.
