The head of relevant departments of the Ministry of homeland said that along with the accelerating process of urbanization and industrialization in China, the forms of land and resources management have been constantly changing, especially the promulgation and implementation of laws and regulations such as administrative penalty law and administrative reconsideration law. The two methods have not adapted to the new situation and new requirements of land and resources management.

The draft has clearly stipulated the scope of application of this method: the administrative department of land and resources of the people's government at or above the county level shall apply these measures to administrative punishments for citizens, legal persons or other organizations violating the laws and regulations governing land and resources management in accordance with statutory functions and procedures.

The above person in charge explained that in addition to the applicable administrative penalties for land and resources, some of the above provisions include, for example, jurisdiction, registration, investigation, evidence collection, trial, decision processing, and so on, which also apply to the following three types of land and resources illegal cases: first, illegal collection and occupation of land, or illegal approval of exploration and exploitation of mineral resources; two, cases of violation of laws and regulations on land and resources should be investigated for Party discipline and government responsibility; three, cases of violation of laws and regulations on land and resources should be investigated for criminal responsibility.

The draft has also added new procedures for trial.

The person in charge said that the purpose of the trial was to ensure fairness and impartiality in the investigation and handling of illegal cases of land and resources, and to strengthen internal supervision to prevent investigators from abusing their power and adjudication.

In addition, the draft also provides clear provisions on the implementation, closing and supervision of administrative penalties for land and resources.

Increase cooperation with CBRC and SFC

The illegal use of land is basically curbed.

In view of the nationwide "unreported and used" illegal land use and rectification, Xu Shaoshi said that 17 provinces in 31 provinces and municipalities have cleared up the "no report for immediate use" registration rate, reaching 96%, and the 15 provinces' closing rate has also reached 90%, which basically curbed the trend of "no report and immediate use" and achieved the expected goal.

He also stressed that the filing rate of national key construction projects is only 77%. Therefore, we should pay close attention to the registration of key national construction projects, and we should not only check and handle matters, but also investigate and deal with people.

According to statistics, in the two years from October 2007 to October 2009, the number of "unreported for use" reached 36 thousand, involving 610 thousand acres of land.

The 31 provinces and autonomous regions of the country have different levels of illegal land use.

He further said that in the first quarter of this year, the number of illegal land use cases handled by the Ministry of land and land decreased by 19%, but the area of land increased by 23%.
